"3-Card Welcome Gift" Terms and Conditions

  1. X Pay acts as the master merchant, collecting the relevant receivables from the user on behalf of the merchant, and factors the payment amount into three instalments, which X Pay will charge to the user flexibly via the user’s linked credit card(s). Users must successfully link an eligible credit card to X Pay and complete the relevant instalment repayment/payment arrangement using the designated credit card(s).
  1. The “3-Card Welcome Gift” and any welcome rewards, welcome offers, spending rebates, reward points, gifts or privileges are provided, processed, verified, approved and fulfilled by the relevant card-issuing bank or financial institution, and are subject to the terms and conditions of the relevant card-issuing bank or financial institution.
  1. X Pay is not the supplier, issuer or service provider of any welcome reward, and shall not be responsible for the content, value, availability, collection arrangement, redemption, expiry, delay or any related disputes concerning any welcome reward.
  1. A user’s eligibility for any welcome reward shall be subject to the final approval and decision of the relevant card-issuing bank or financial institution. Different banks may have different definitions of “new customer”, “welcome offer”, “eligible transaction” and “fulfilment arrangement”. Please refer to the latest announcements published by the relevant card-issuing bank or financial institution for details.
  1. Where a user makes instalment payments via X Pay or uses different credit cards to settle different instalment payments, whether such transactions will be classified as an online or offline (in-person) transaction, whether they will be regarded as eligible welcome-offer spending, whether the user is entitled to any welcome offer, and how such offer is calculated, shall be subject to the final decision of the relevant card-issuing bank or financial institution in accordance with its internal criteria and applicable terms. X Pay makes no representation or warranty as to the outcome of any such classification or calculation. The user further acknowledges that, as X Pay acts as the master merchant of record for such payments, the relevant credit card transaction will appear on the card system and statement under the name of X Pay (rather than the original merchant), which may be a factor considered by the card-issuing bank or financial institution in determining transaction classification and welcome-offer eligibility. X Pay bears no responsibility for, and has no ability to influence or guarantee, how any bank processes or classifies such transactions.
  1. X Pay shall not be liable in any case where a user fails to receive any welcome reward due to credit card application results, approval status, account status, failed transactions, cancelled transactions, refunds, chargebacks, card replacement, overdue repayment, abnormal account status, or failure to satisfy the requirements of the relevant bank.
  1. [New] The user’s relationship with X Pay (including the Deferred Payment Agreement entered into in respect of any instalment payment arrangement, and these Terms and Conditions) is separate and distinct from the user’s relationship with the relevant card-issuing bank or financial institution in respect of any welcome reward. The user acknowledges and agrees that entering into X Pay’s Deferred Payment Agreement (https://zero-xpay.com/en/deferred-payment-agreement/) constitutes an instalment payment arrangement between the user and X Pay only, and does not constitute, affect, guarantee or imply the user’s eligibility for any welcome reward offered by any card-issuing bank or financial institution.
  1. [New] Where a user chooses to use multiple credit cards to settle different instalments of a single transaction, the user is solely responsible for understanding and complying with the terms and conditions of each relevant card-issuing bank or financial institution in respect of the applicable welcome offer, including (without limitation) any requirements relating to “single applicant per offer”, “genuine incremental spend”, prohibition on split transactions, or other anti-abuse provisions. X Pay shall bear no responsibility, and shall not compensate the user in any way, where such an arrangement is determined by the relevant bank to be non-compliant with its offer terms (including being treated as a split transaction, non-genuine spend, or offer abuse), resulting in the user’s welcome reward being withheld, clawed back or cancelled.
  1. In the event of any dispute, X Pay reserves the right of final interpretation of the content of this promotional page; however, matters relating to eligibility, approval, fulfilment and related arrangements of welcome rewards shall be subject to the final decision of the relevant card-issuing bank or financial institution.
